1. Acceptance of Terms

By creating an account, browsing listings, submitting a vendor or fleet application, or engaging in any interaction through Briz-In ("Platform", "we", "our", or "us"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service. If you do not agree to these terms, you must refrain from accessing or utilizing our services.

2. Marketplace Role & Scope of Services

Briz-In operates exclusively as an online transport discovery and marketplace intermediary platform. We connect prospective customers seeking vehicle rentals, dispatch riders, haulage, and motor park itineraries with independent vehicle owners, fleet operators, and registered logistics vendors.

Except where explicitly stated otherwise, Briz-In does not own, operate, store, or physically inspect vehicles or machinery listed by third-party vendors. The physical rental contract, vehicle dispatch agreement, or charter arrangement is formed directly between the customer and the respective vehicle owner or fleet vendor.

3. User Accounts & Phone Verification

To list vehicles, hire logistics, post job requisitions, or bookmark favorites, users must maintain an active verified account. You agree to:

• Provide a genuine, active Nigerian phone number capable of receiving SMS OTP authentication codes.
• Maintain the confidentiality and security of your account credentials.
• Accept full accountability for all actions, communications, and bookings conducted under your account credentials.
• Immediately notify our operations desk if you discover any unauthorized use of your profile.

4. Vendor & Fleet Operator Obligations

All vendors listing vehicles, bikes, or haulage equipment on Briz-In warrant that:

• They hold lawful title or valid authority from the registered owner to lease, dispatch, or charter the vehicle.
• All listed vehicles possess valid roadworthiness certificates, state vehicle licenses, and mandatory third-party or comprehensive insurance under Nigerian traffic laws.
• All allocated drivers possess valid Nigerian commercial driver's licenses and have been appropriately vetted.
• Vehicle photos, pricing, capacity, and service areas (e.g. Warri, Delta State, Lagos) published on their storefront are truthful and accurate.

5. Fees, Subscriptions & Payment Gateway

Online payments on Briz-In—including vendor identity verification fees, recurring vendor listing plans, and fleet management subscriptions—are processed through Paystack Payments Limited, a licensed Payment Solution Service Provider (PSSP) regulated by the Central Bank of Nigeria.

• KYC Fees: Identity verification processing fees charged for NIN and government document checks are non-refundable once verification processing is triggered.
• Subscriptions: Vendor and Fleet subscription plans renew according to the chosen billing cycle unless cancelled prior to renewal.
• Direct Rental Payments: Cash-on-delivery, bank transfer, or offline rental fees negotiated directly between customers and vendors are governed by their individual agreements.

6. Prohibited Activities

Users and vendors are strictly forbidden from engaging in:

• Listing stolen, impounded, unlicensed, or mechanically hazardous vehicles.
• Using dispatch or haulage vehicles for illicit contraband, unregulated substances, or unauthorized transport.
• Submitting fraudulent identification documents, NINs, or fake license numbers.
• Circumventing platform security, conducting denial of service attacks, or scraping listing records without written authorization.

7. Limitation of Liability

To the maximum extent permitted under applicable Nigerian law, Briz-In, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from vehicle breakdowns, road accidents, personal injuries, transit delays, or loss of goods occurring during third-party bookings. Customers and vendors are encouraged to inspect vehicles thoroughly before departure.

8. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. In the event of any legal controversy or claim arising out of these terms, the parties agree to first seek amicable settlement through mediation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the competent courts in Delta State or Lagos State, Nigeria.
